1. Acceptance of Terms

By accessing or using FantasyEdge (the "Site"), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, our Privacy Policy, and all other policies and rules posted on the Site. Your use of the Site signifies your explicit acceptance of these terms. If you do not agree to all of these terms, you must not use or access the Site.

2. Eligibility

You represent and warrant that you meet all eligibility requirements. In particular:

  • You must be at least 13 years old (or older if required by your local jurisdiction) to use this Site. Anyone under the age of 18 (or the age of majority in your jurisdiction) should only use this Site with the involvement and verifiable consent of a parent or legal guardian. FantasyEdge is not intended for children under 13 years of age, and we do not knowingly collect personal information from children under 13 without verifiable parental consent in compliance with the Children's Online Privacy Protection Act (COPPA).
  • You must not be barred from using online fantasy sports services by any applicable law or regulation. You agree to comply with all local, national, and international laws that apply to your use of the Site, including those pertaining to online conduct and content, and you are solely responsible for ensuring your use of FantasyEdge's services complies with all applicable laws in your jurisdiction.
3. Use of the Site and Content & Prohibited Activities

FantasyEdge provides fantasy sports tools, analysis, rankings, news, and related content for informational and entertainment purposes. All content on the Site (including text, graphics, data, charts, images, videos, software, and other materials) is intended for your personal, non‑commercial use only.

You agree not to:

  • Copy, reproduce, distribute, republish, upload, post, publicly display, or create derivative works of the Site content without our prior written consent.
  • Use the Site or its content in any unlawful manner, or for any purpose that is unlawful or prohibited by these Terms.
  • Remove or alter any copyright, trademark, or other proprietary notices from the Site or its content.
  • Engage in any illegal, fraudulent, or unethical conduct.
  • Misuse or divulge any non-public, confidential, or proprietary information of FantasyEdge or its users.
  • Infringe upon any third-party rights, including intellectual property (copyright, trademark, patent, trade secret) or privacy rights.
  • Upload, post, share, or distribute content that is unlawful, threatening, abusive, harassing, defamatory, libelous, deceptive, fraudulent, invasive of privacy, tortious, or contains explicit or graphic descriptions of sexual acts.
  • Victimize, harass, degrade, or intimidate individuals or groups based on religion, gender, sexual orientation, race, ethnicity, age, disability, or any other protected characteristic.
  • Engage in spamming, unauthorized advertising, chain letters, pyramid schemes, or any form of unsolicited commercial communication.
  • Introduce or transmit software viruses, malware, worms, Trojan horses, or any other computer code designed to disrupt, damage, or limit the functionality of any software, hardware, or telecommunications equipment.
  • Attempt to gain unauthorized access to the Site, other user accounts, computer systems, or networks connected to FantasyEdge's services.
  • Disrupt the normal operation or security systems of the Site.
  • Use the Site or its content for any gambling, betting, or illegal wagering activities, or to facilitate, promote, or engage in any form of gambling or illegal wagering.

FantasyEdge reserves the right to limit, suspend, or terminate your access to the Site at any time for any reason, including if you violate any of these Terms. We also reserve the right, but have no obligation, to remove or refuse to post any User Content for any or no reason in our sole discretion.

4. Intellectual Property Rights

All content and materials on the Site, including text, graphics, data, charts, images, videos, software, and other materials, are owned by FantasyEdge or its licensors, and are protected by copyright, trademark, patent, trade secret, and other intellectual property laws. FantasyEdge (or its licensors) retains all rights, title, and interest in and to the Site and its content. You are granted a limited, nonexclusive, non-transferable, revocable license to access and view the content on the Site solely for personal, non-commercial use. Unless expressly stated, no portion of the Site's content may be copied or used for any other purpose without FantasyEdge's express written permission.

4.1 User-Generated Content (UGC): If FantasyEdge offers features allowing you to submit, post, or transmit content (e.g., comments, forum posts, saved preferences) ("User-Generated Content" or "UGC"), you are solely responsible for your UGC and for all activity that occurs under your account. By submitting UGC, you represent and warrant that you own or control all rights to your UGC, or that you have all necessary rights, licenses, and consents from third parties to submit it. You grant FantasyEdge a worldwide, perpetual, irrevocable, sublicenseable, transferable, assignable, non-exclusive, and royalty-free right and license to use, reproduce, distribute, adapt, modify, translate, create derivative works based upon, publicly perform, publicly display, and otherwise exploit your UGC for any purpose, in any form, media, or technology now known or hereafter developed. You waive any moral rights you may have in your UGC.

4.2 Digital Millennium Copyright Act (DMCA) Notice and Takedown Procedure: FantasyEdge respects the intellectual property rights of others and expects its users to do the same. We comply with the Digital Millennium Copyright Act (DMCA) and will respond to clear notices of alleged copyright infringement that comply with the DMCA.

5. User Accounts and Security

If FantasyEdge offers account-based features (such as saving preferences, receiving personalized content, or accessing member areas), you may create an account and choose a username and password. You agree to:

  • Provide accurate, current, and complete information when creating an account.
  • Keep your account login credentials confidential and secure. You are solely responsible for all activities that occur under your account or using your password, whether done by you or any third person using your account.
  • Notify FantasyEdge immediately of any unauthorized use of your account or any other breach of security.
  • You may not share, sell, transfer, or assign your account or any account rights to any other person.

FantasyEdge will not be liable for any loss or damage arising from your failure to comply with these obligations. You agree that FantasyEdge is not responsible for any actions taken by anyone to whom you have given access to your account. FantasyEdge is committed to implementing reasonable security measures to protect user data and encourages users to utilize any security features offered, such as multi-factor authentication, if available.

6. Payments and Subscriptions (if applicable)

FantasyEdge currently provides its tools and content free of charge. In the future, if FantasyEdge offers any paid subscription plans or premium services, the following will apply:

  • Payment: You agree to pay the subscription fees for any paid service you purchase. Payment is due in advance (monthly or annually as specified) and will be charged using the payment method you provide. Prices and payment terms will be clearly posted at the time of purchase.
  • Automatic Renewal: Unless you cancel before a renewal date, paid subscriptions will automatically renew at the then-current rate. You must cancel your subscription before the end of the current billing period to avoid renewal.
  • Cancellations and Refunds: You may cancel a paid subscription at any time through your account settings or by contacting support. Any cancellation takes effect at the end of the current billing period; you will not receive a refund for the current period, and you will continue to have access to the premium service until the billing cycle ends. In general, all subscription fees are non-refundable, except as required by applicable law.
  • Taxes: You are responsible for all taxes, duties, or fees associated with your payments.

(Note: The above payment terms apply only if FantasyEdge introduces paid features. No payment is required to use the Site's free tools and content.)

7. Disclaimers and Limitations of Liability

ALL CONTENT ON THE SITE IS PROVIDED "AS IS" AND "AS AVAILABLE" FOR INFORMATIONAL AND ENTERTAINMENT PURPOSES ONLY. FantasyEdge makes no representations or warranties of any kind, express or implied, about the accuracy, completeness, or reliability of any content. You agree that use of the Site and its content is at your own risk.

7.1 Not Professional Advice: FantasyEdge's tools and content (including projections, rankings, or analysis) are not professional financial, legal, medical, or other advice. You should not rely on them as a sole basis for making decisions. FantasyEdge is not liable for any decisions or actions you take based on the Site's content.

7.2 Not a Gambling or Betting Site: FantasyEdge is a skill-based fantasy sports analysis site only. It is not a gambling or betting platform, and it does not accept wagers or facilitate betting in any form. All content is for general entertainment, educational, and informational use. Any references to game outcomes, predictions, or probabilities are not guarantees of success or financial gain. You acknowledge and agree that you will not use the Site for any gambling, betting, or illegal wagering activities.

7.3 No Warranties: FantasyEdge expressly disclaims all warranties, whether express or implied, regarding the Site and its content, including any warranty of accuracy, reliability, merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee the Site will be uninterrupted, timely, secure, or error-free, and we will not be liable if the Site or any content is unavailable for any reason.

7.4 Limitation of Liability: To the fullest extent permitted by applicable law, FantasyEdge (and its officers, directors, employees, and agents) will not be liable for any indirect, special, incidental, consequential, exemplary, or punitive damages, or any damages whatsoever (including, without limitation, loss of use, data, goodwill, sales, business, agreements, anticipated savings, or profits), arising out of your use of the Site, even if advised of the possibility of such damages. FantasyEdge's total liability to you for any claim arising from or relating to the Site will not exceed the fees paid by you for the relevant service (if any), or $100 (one hundred dollars), whichever is greater. You agree that any claims must be brought within one year after the claim arises. Some jurisdictions do not allow the exclusion or limitation of liability for certain damages, so these limitations may not apply to you.

8. Indemnification

You agree to defend, indemnify, and hold harmless FantasyEdge (including its officers, directors, employees, agents, and affiliates) from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorney's fees) arising from or in connection with:

  • Your access to or use of the Site.
  • Your violation or alleged violation of these Terms and Conditions.
  • Your infringement or alleged infringement of any third-party rights, including intellectual property, privacy, or publicity rights.
  • Any content submitted, posted, or transmitted by you on or through the Site.
9. Third-Party Links

FantasyEdge may include links to third-party websites, resources, or content that are not owned or controlled by us. We do not endorse or assume any responsibility for these external sites or their content. Visiting or using any third-party site is at your own risk. FantasyEdge makes no representations about such sites; their inclusion does not imply any endorsement by FantasyEdge. We encourage you to review the terms and privacy policies of any linked sites before using them.

10. Modifications to the Terms

FantasyEdge reserves the right to modify or update these Terms at any time by posting the revised terms on this page. The date at the top reflects the latest revision. When changes are made, we will update the "Last updated" date. Your continued use of the Site after the terms are changed constitutes your acceptance of the new Terms. It is your responsibility to review these Terms periodically for any changes.

11. Privacy Policy

Your use of the Site is also governed by our Privacy Policy, which is incorporated by reference into these Terms and Conditions. The Privacy Policy explains how FantasyEdge collects, uses, stores, and protects your personal data, as well as your rights regarding your data. We encourage you to read our Privacy Policy carefully. By agreeing to these Terms, you also agree to the terms of our Privacy Policy. We are committed to transparency in our data practices and ensuring consistency between these Terms and our Privacy Policy.

12. Accessibility

FantasyEdge is committed to making its Site accessible to all users, including those with disabilities. We strive to comply with applicable accessibility standards and guidelines, such as the Web Content Accessibility Guidelines (WCAG). If you encounter any accessibility barriers while using our Site, please contact us using the information in Section 17.

13. Governing Law and Dispute Resolution

13.1 Governing Law: These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.

13.2 Mandatory Binding Arbitration: Any controversy or claim arising out of or relating to these Terms, or the breach thereof, shall be settled by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules, and judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof. Waiver of Jury Trial: You and FantasyEdge hereby waive any constitutional and statutory rights to go to court and have a trial in front of a judge or a jury, instead electing that all claims and disputes shall be resolved by arbitration under this Arbitration Agreement. Waiver of Class Actions: All claims and disputes within the scope of this Arbitration Agreement must be arbitrated or litigated on an individual basis and not on a class basis. Claims of more than one customer or user cannot be arbitrated or litigated jointly or consolidated with those of any other customer or user.

13.3 Jurisdiction for Injunctive Relief: Notwithstanding the foregoing, FantasyEdge may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of our copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

14. Force Majeure

Neither party shall be liable or responsible to the other party, nor be deemed to have defaulted under or breached this Agreement, for any failure or delay in fulfilling or performing any term of this Agreement (except for any obligations to make previously owed payments) when and to the extent such failure or delay is caused by or results from acts or circumstances beyond the reasonable control of the affected party ("Force Majeure Event"), including, without limitation, acts of God, natural disasters (e.g., earthquakes, floods, epidemics, pandemics), war, terrorism, riots, embargoes, acts of civil or military authorities, fires, floods, accidents, strikes, or shortages of transportation facilities, fuel, energy, labor, or materials. The party affected by a Force Majeure Event shall provide prompt written notice to the other party and shall use reasonable efforts to minimize the consequences and resume performance as soon as practicable.

15. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court or tribunal of competent jurisdiction, such provision shall be severed from these Terms, and the remaining provisions will remain in full force and effect. The invalid or unenforceable portion shall be interpreted in a manner consistent with applicable law to reflect, as nearly as possible, the original intent of the parties.

16. Entire Agreement

These Terms and Conditions, together with our Privacy Policy and any other documents expressly incorporated by reference herein, constitute the entire agreement between you and FantasyEdge regarding your use of the Site and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, with respect to the subject matter hereof. No oral modification or amendment to these Terms shall be valid or binding.
